1. Acceptance of Terms

By creating an account or using Focus Pocus, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our service.

2. Description of Service

Focus Pocus is a productivity application that helps you manage tasks, goals, habits, and focus sessions. The service includes:

Task and goal management
Habit tracking
Focus session timer
AI-powered productivity assistance
Email-to-task conversion
Calendar integration and visualization
AI agent task processing, where available

3. Account Registration

To use Focus Pocus, you must create an account using Google Sign-In. You are responsible for:

Maintaining the security of your account
All activities that occur under your account
Notifying us immediately of any unauthorized access

4. Acceptable Use

You agree not to:

Use the service for any unlawful purpose
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the service
Upload malicious content or code
Violate the rights of others
Use the service to send spam or unsolicited messages

5. User Content

You retain ownership of all content you create in Focus Pocus (tasks, goals, journal entries, etc.). By using our service, you grant us a limited license to store, process, and display your content as necessary to provide the service.

You are responsible for ensuring your content does not violate any laws or third-party rights.

6. Third-Party Integrations

Focus Pocus integrates with third-party services including Google Calendar. When you connect these services:

You authorize us to access data from those services as described in our Privacy Policy
Your use of third-party services is subject to their own terms and policies
You can disconnect integrations at any time from your account settings

7. Agent Credits and Billing

Credit Terms

Credits are pre-paid, non-transferable, closed-loop service credits used to power AI agent task processing. Credits are not stored value and cannot be converted to cash, transferred to other users, or used outside the Focus Pocus platform.

Credit Pricing

Credit pricing is displayed at checkout. Stripe payment processing fees are passed through to the user at checkout and are non-refundable.

Credit Expiration

Credits do not expire under normal use. We reserve the right to expire credits after 365 days of account inactivity.

Refund Policy

Credits are refundable within 24 hours of purchase (unused portion only). After 24 hours, credits are non-refundable. Processing fees are non-refundable regardless of timing.

Spending Caps

You may set daily and monthly spending caps. These caps are best-effort safeguards, not guaranteed limits. In-flight API calls may cause minor overshoot beyond your configured cap.

Pricing Changes

We may adjust credit pricing as upstream AI processing costs change. You will be notified of price changes. Existing credit balances are honored at the rate at which they were purchased.

Account Termination

Except for refunds expressly allowed under the Refund Policy above, unused credits are forfeited upon account termination.

8. AI Features

Focus Pocus uses artificial intelligence to provide features such as task prioritization and content extraction. You understand that:

AI-generated suggestions are provided as assistance, not definitive advice
You are responsible for reviewing and approving AI-generated content
AI features may not always be accurate or available
Agent output is provided "as-is." We make no guarantee of accuracy, completeness, or fitness for any particular purpose. You are responsible for reviewing all agent-generated work before acting on it.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

Perform maintenance that temporarily affects availability
Modify or discontinue features with reasonable notice
Suspend accounts that violate these Terms
AI agent availability depends on third-party API availability. We do not guarantee any specific uptime or service level for agent features.

10. Limitation of Liability

To the maximum extent permitted by law, Focus Pocus and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

11. Disclaimer of Warranties

The service is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

12. Termination

You may terminate your account at any time by contacting us or using the account deletion feature. We may terminate or suspend your account if you violate these Terms.

Upon termination, your right to use the service ceases immediately. We will delete your data in accordance with our Privacy Policy.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the service. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
